Overview of Training Contract
A Training Contract is a legal contract which shows that the trainee and the employer have come to an agreement. This is a requirement of a traineeship.
Graduates do not need to enter into a Training Contract. Some of the things that will have been agreed upon include:
- the qualification the trainee is working towards (this is chosen by the Office for the Public Sector)
- how long it will take to complete (standards are between 10 – 12 months)
- the number of hours in training and employment provided each week (this is in most cases 37.5 hours)
- the obligations to each other
- what to do if there is a problem
- the off-job and on-job training arrangements.
The Training Contract is a legal document and is governed by state legislation (Training and Skills Development Act 2008). It needs to be signed by the trainee, the employer (agency) and a parent or guardian (if the trainee is under 18). By signing, all parties are agreeing with all the information contained in the contract, and they are bound by it.
The Australian Apprenticeships Centre helps the trainee and the employer to reach an agreement and it draws up the Training Contract.
The Training Contract is submitted to Traineeship and Apprenticeship Services, Department for State Development for assessment and approval.
Traineeship and Apprenticeship Services must be advised of any changes agreed to after the lodgement. If for any reason Traineeship and Apprenticeship Services does not approve the Training Contract, you will be advised in writing.
Every Training Contract has a predetermined probation period, which is 1 month for the Certificate III in Business and as this is also governed by state legislation cannot be amended.
At the completion of the Training Contract, between the provider of the training and the Australian Apprenticeships Centre the trainee will be assisted to complete the necessary paperwork to notify Traineeship and Apprenticeship Services of their successful completion. If some reason the trainee does not complete the traineeship the Australian Apprenticeships Centre can assist to submit the necessary termination paperwork.
