The Public Interest Disclosure Act 2018 (PID Act) establishes a scheme that encourages and supports the disclosure of public interest information to appropriate people or authorities.

The PID Act:

  • provides protections for some people who make an appropriate disclosure
  • sets out how disclosures must be managed.

Making a disclosure about OCPSE

You can make an appropriate disclosure of public administration information about OCPSE or an OCPSE employee to:

  • an OCPSE responsible officer, or
  • another relevant authority under the PID Act.

Before making a disclosure, consider:

  • whether your information meets the definition of an appropriate disclosure under the PID Act
  • who is the appropriate authority to receive the disclosure
  • whether you have obligations under:

Responsibilities

All public officers, including public sector employees, must comply with the PID Act.

A public officer must report to the OPI any matter they reasonably suspect involves corruption in public administration, unless they know it has already been reported.

Reporting misconduct or maladministration is not mandatory. However, the Ombudsman expects public officers to report to Ombudsman SA where they reasonably suspect:

  • misconduct in public administration, or
  • maladministration in public administration

These matters can also be reported to the OPI.

Making a disclosure to other relevant authorities

You can make a public interest disclosure to other relevant authorities, as defined in the PID Act.

You can also make a disclosure directly to the Office for Public Integrity (OPI).

The Commissioner for Public Sector Employment is a relevant authority and can receive disclosures about any public sector agency or employee (see section 5(b)(i) of the PID Act).
